# G.T.U – GENERAL TERMS OF USE
Please read the following terms carefully before using the Website www.wellbox.com (hereinafter “the Site”) which belongs to LPG SYSTEMS S.A.S (hereinafter referred to as « LPG »).
The use of the Site constitutes acceptance of these conditions. Consequently, by accessing the Site, any user browsing the Site declares to have read and unreservedly accepted these conditions of use, and undertakes to comply with them and to respect in all circumstances the rules defined below.
ARTICLE 1 – ACCESS TO THE SITE
The editorial content of the Site is accessible free of charge from anywhere by any user with Internet access. All fees necessary for access to services (computer equipment, Internet connection, etc.) are the responsibility of the user.
Access to the e-shop requires the creation of an account. For this the user must have a valid email address.
The user agrees to provide and maintain accurate, current and complete information about him. LPG shall under no circumstances be held liable in the event of delay or impossibility for the user to access his account due to incorrect or incomplete information in the entry of his information when creating his account. As such, the user may at any time modify his personal information.
The user’s identification settings (username and password) are personal and confidential. The user is solely responsible for preserving the confidentiality of his login credentials and undertakes to take all necessary measures to ensure this complete confidentiality; He will also make sure to log out after each session.
Under no circumstances shall LPG be liable for the loss, theft or forgetfulness of the user authentication elements or their fraudulent use.
Any connection to the Site with the user’s login credentials is deemed to be made by the user himself. The user undertakes to immediately inform LPG of any unauthorized use of its login credentials, and more generally of any possible breach of the security of the Site of which he is aware.
In case of loss, forgetfulness or theft of his password, the user will be able to change it by clicking on the button «Forgotten password» located under the form for entering the login credentials.
ARTICLE 2 – INTELLECTUAL PROPERTY
2.1. The title, design, form, content (brands, texts, colour organization, illustrations, photographs and images) of the Site, its general architecture and presentation, but also any software, software compilation, source code, and more generally, all information or documents contained on the Site and all elements created for this Site are either the property of LPG or its subsidiaries, or are the subject of rights of use, reproduction and representation granted to the latter.
2.2. The Site constitutes a work protected in France by the Code of Intellectual Property, and abroad by the international conventions in force on copyright. The violation of one of the copyrights of the work is an infringement offence punishable by Articles L.331-1 and following of the French Code of Intellectual Property, without prejudice to the sanctions provided for in case of violation of French law n°78-17 of 6 January 1978 as amended on Data Processing, Files and Freedoms and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on data protection. The entire content of the Site – including text, images, graphic presentations and/or audiovisual files – is protected by law and may not be sold, modified, distributed, reused, repositioned, exploited, represented, reproduced or used, in whole or in part, in any way for public or commercial use, whatever the medium, without prior written permission from LPG.
In case of prior and express authorization given by LPG, the authorized reproduction of the information contained on the Site must indicate the appropriate source and ownership.
2.3. LPG does not authorize Internet users to electronically copy and print on paper documents and/or elements contained on this Site whatever the intended use. No license, nor any right other than to consult the Site, is granted to anyone with regard to intellectual property rights.
2.4. Unless otherwise stated, the company names, logos, products, brands and all distinctive signs cited on the Site are the property of LPG SYSTEMS Company or its subsidiaries, or are subject to the right of use, of reproduction and representation granted for the benefit of the latter, in particular, without this list being exhaustive, the signs LPG SYSTEMS®, LPG®, ENDERMOLOGIE® and WELLBOX® which are trademarks registered and/or registered in France and/or abroad. Also, company names, trade names, signs, domain names, logos, slogans, products, brands and more generally any distinctive sign, cited on the Site, may not be used without the prior written permission of LPG.
In addition, WELLBOX devices are protected by patents and/or designs.
2.5. The Site constitutes as such a database, including web pages and data formatted by LPG.
Some pages of the Site also constitute specific databases and may contain personal data, such as the section «Contact us» (on which the user transmits his personal data to LPG through the contact form).
The personal data contained in these databases are processed under the conditions laid down in Article 6 below.
The databases on the Site are and remain the property of LPG, which holds both the copyright and the sui generis right of the database producer referred to in Article L341-1 of the French Intellectual Property Code.
LPG, as database producer and publisher of the Site, prohibits:
– the extraction, by permanent or temporary transfer of all or part qualitatively or quantitatively substantial of the web pages and data on another medium, by any means and in any form whatsoever;
– the re-use, by making available to the public all or a qualitatively or quantitatively substantial part of the web pages and data, in whatever form;
– the repeated and systematic extraction or reuse of qualitatively or quantitatively non-substantial parts of web pages and data where such operations clearly exceed the normal conditions of use;
– any unfair collection and misappropriation of data (including personal data) that may be published on the Site, and any act that may infringe the privacy or consideration of individuals.
Any representation, reproduction, distribution, extraction by any means, even partial of the Site and/ or its content without the consent of LPG is therefore illegal and sanctioned by articles L.335-2 and following, L.343-1 and following of the French Intellectual Property Code.

3.1. The Site is not intended to provide medical and/or paramedical advice. All information presented on the Site is for information purposes only. LPG does not guarantee that the information accessible via the Site is complete and up to date. SECTION 4 – HYPERLINKS – HYPERLINKS

4.2. Activation of the links offered by the Site: LPG formally declines all responsibility for the content of the sites to which it offers links, giving access to web pages other than those of its Site. These links are offered to users of the Site as a service. The decision to activate the links belongs exclusively to the users of the Site.
Under no circumstances can LPG be held responsible for:
– edits and content of materials on these other websites;
– the use of trademarks, logos and other distinctive signs as well as images appearing on the websites reproduced after the activation of the hyper link;
– the integrity and completeness of the information provided by these other websites.
ARTICLE 5 – RESPONSIBILITY
5.1. LPG cannot guarantee the availability and time of access to the Site, and cannot be held responsible for the timeliness, deletion, failure to upload, failure to store information. The modalities of maintenance, testing and upgrading operations are freely chosen and performed by LPG, at any time, regardless of the procedures and means used for this purpose.
LPG makes the best efforts to maintain access to the Site. However, it may have to interrupt access to the Site, temporarily or permanently, in particular for legal, technical or maintenance reasons.
5.2. Neither LPG, nor any of its affiliates, officers, employees or other representatives, shall be liable for any damages, loss of data, direct or indirect material and immaterial damages, such as loss of market, loss of customers, loss of data, income or loss of income suffered by a user in connection with the use of the Site and in general, any commercial disturbance, which could result from the inability to access this Site, regardless of the duration, the use of incorrect information and/or content.
ARTICLE 6 – PERSONAL DATA
6.1. The Internet user accepts that the personal information concerning him, collected by LPG on the Site, is processed by automated or non-automated means (if such personal data are contained or required to appear in a file) according to the purposes chosen at the time of collection of its data on the Site by ticking the corresponding boxes (such as the processing of orders placed by the user, operations related to the management of customers/ prospects, operations related to prospecting and the management of opinions of people on its products, services or content).

Personal information about the user is intended for LPG, its subsidiaries, distributors and sub-companies, processors within the meaning of Article 28 of the GDPR, subject respectively to national and European provisions relating to the protection of personal data.
Mandatory data are indicated during collection. In their absence, no request can be taken into account. These data are kept for the time necessary for the operations for which they were collected and in compliance with the regulations in force.
Thus:
– LPG’s customer data is retained for the duration of the contractual relationship, plus three (3) years from the end of the contractual relationship, with the exception of banking data that is retained:
o in case of one-off payment until the withdrawal period expires
o in the event of payment in instalments until full collection by LPG of the sums due.
– Lead data is kept for a period of 3 years from the last contact with LPG.
– Customer accounts are deleted after four years of total inactivity.
Without prejudice to statutory retention obligations or limitation periods.
6.2. In order to facilitate and track the navigation of the user on the Site, LPG may also automatically collect information through cookies, in order to improve the personalized service that is intended for the user.
When you visit the Site, you can set cookies to accept or refuse them. He may indicate his preference either overall for the Sites or service by service.
However, for technical reasons, users are advised that certain services and/or access to certain web pages may not be accessible to them if they refuse a cookie installation.
6.3. ARTICLE 7 – APPLICABLE LAW – DISPUTE RESOLUTION
7.1. This Site and its Terms of Use are governed exclusively by French law. These Terms of Use are written in French. In the event that they are translated into one or more languages, only the French text will be deemed authentic in the event of a dispute.
7.2. Complaints or disputes will always be received with attentive benevolence. In the event of a dispute, Internet users may contact LPG SYSTEMS for an amicable solution by mail at LPG SYSTEMS – 30, rue Dr Abel – Technoparc de la Plaine – 26000 VALENCE (FRANCE) or by e-mail at ServiceClientWellbox@lpgsystems.com.
In the event of dispute(s) arising from these GCU, the parties will meet for conciliation purposes at the initiative of the most diligent party.
Should the parties fail to reach an amicable solution within one (1) month of the first conciliation meeting, they shall be free to submit their dispute(s) to the competent jurisdiction in application of French procedural rules.
